Data Protection Declaration

1. General

This Privacy Policy informs users of the website www.lawfirm.at (hereinafter referred to as the ‘Website’) and other data subjects within the meaning of the GDPR, in particular clients, about the nature, scope and purposes of the collection and use of personal data by the law firm GPK Pegger Kofler & Partner Rechtsanwälte GmbH & Co KG, AT 6020 Innsbruck, Maria-Theresien-Str. 24.

Personal data refers to any data containing specific details about personal or factual circumstances, such as name, address, email address, telephone number, date of birth, age, gender, national insurance number, video recordings, photographs, voice recordings of individuals, and biometric data such as fingerprints. Sensitive data, such as health data or data relating to criminal proceedings, may also be included.

2. Your rights

Where the lawfulness of a specific data processing operation is based on the data subject’s consent, this consent may be withdrawn at any time (including in part) via the contact details provided below (point 13).

Furthermore, subject to any obligations of professional secrecy, every data subject has the right to access their personal data, to data portability, to the rectification or erasure of personal data, and to restrict or object to the processing of their personal data. The user may exercise these rights by sending an email to office@lawfirm.at or in writing to the contact address below (point 13).

Finally, the user has the right to lodge a complaint with the Austrian Data Protection Authority (Barichgasse 40–42, 1030 Vienna, dsb@dsb.gv.at ,  www.dsb.gv.at).
Notwithstanding the deletion provisions set out below in relation to individual data processing operations, deletion shall not take place to the extent that the personal data to be deleted is used for other lawful processing purposes (e.g. direct marketing) in accordance with this privacy policy.

3. Data security

Your personal data is protected by appropriate technical and organisational measures. These measures relate in particular to protection against unauthorised, unlawful or accidental access, processing, loss, use and manipulation.

Notwithstanding our efforts to maintain a consistently high standard of due care, it cannot be ruled out that information you provide to us via the internet or electronically may be viewed and used by other persons.

Please note that we therefore accept no liability whatsoever for the disclosure of information resulting from errors in data transmission not caused by us and/or unauthorised access by third parties (e.g. hacker attacks).

4. Use of data

We collect only such personal data as is necessary for the performance and handling of our legal services or other business transactions, or which you have voluntarily provided to us.

We process and transfer personal data only in a lawful manner – in particular to fulfil contractual obligations, on the basis of overriding legitimate interests (appropriate handling of the client mandate), on the basis of a public interest or a legal obligation, or on the basis of consent.

We will therefore not process the data provided to us for any purposes other than those covered by the client agreement, other contracts, your consent, or any other provision in accordance with the GDPR (e.g. direct marketing as defined in point 9). An exception to this is the use of data for statistical purposes, provided that the data provided has been anonymised.

5. Transfer of data to third parties

In the course of our case work, it may also be necessary to transfer your data to third parties (e.g. the opposing party, substitute lawyers, insurance companies, banks, service providers we use and to whom we provide data, etc.), courts or public authorities. Any transfer of your data takes place exclusively on the basis of the GDPR, in particular to handle your case properly or on the basis of your prior consent.

Specifically, we transfer your data to Panta Rhei Informationsmanagement GmbH, Zoom Video Communications, Inc., Microsoft Corporation, AI:ssociate FlexCo and LexisNexis SA.

Furthermore, we would like to inform you that, as part of our legal representation and support, we regularly obtain factual and case-related information about you from third parties. Such data sources may include clients, courts, parties, other participants in proceedings or publicly accessible sources (the internet, the commercial register, the land register, etc.).

Some of the above-mentioned recipients of your personal data are located outside your country or process your personal data there. The level of data protection in other countries may not correspond to that in Austria. However, we will only transfer your personal data to such countries if either the European Commission has determined that they have an adequate level of data protection, or we have entered into standard contractual clauses, or another legal basis under Article 44 et seq. of the GDPR applies (e.g. your informed consent). Specifically, we transfer your data to the USA, for which an adequacy decision is in place.

6. Notification of data breaches

We endeavour to ensure that data breaches are detected at an early stage and, where necessary, reported without delay to you or the relevant supervisory authority, specifying the categories of data affected.

7. Retention of data

We will not retain data for longer than is necessary to fulfil our contractual or legal obligations and to defend against any potential liability claims, unless the data is processed for other legitimate purposes (e.g. direct marketing as defined in point 9). In the latter case, the data will be deleted once the purpose no longer applies. In any event, your data will be deleted 30 years after the end of the mandate, at the earliest six months after the expiry of the retention periods under Section 12 of the Austrian Lawyers’ Act (RAO) (5 years or, in the case of mandates under Section 8a (1) RAO, 10 years).

8. Server Log Files

In order to optimise this Website in terms of system performance, user-friendliness and the provision of useful information about our services, the Website provider automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. This includes your Internet Protocol address (IP address), browser and language settings, operating system, referrer URL, your Internet service provider and the date and time.

This data is not combined with any personal data sources. We reserve the right to review this data retrospectively should we become aware of specific indications of unlawful use.

Furthermore, the temporary storage of your device’s IP address is necessary for the provision of the Website’s content. Your IP address will be deleted once you have finished using the Website.

We use the aforementioned data solely for statistical purposes.

9. Direct marketing

In accordance with Section 174 (3) of the Telecommunications Act (TKG) and Article 6 (1) (f) of the GDPR, we will permanently store the data categories title, first name and surname, postal address, email address and telephone number for our own promotional purposes and use it to send offers and information about our services and offers by post or email. This also includes invitations to events organised by our law firm. You may object to the processing of your data for this purpose at the time of collection or at any time thereafter by contacting us using the contact details below.

10. User enquiries

When you contact us (for example, via the contact form on this Website or by email), the following details are stored for the purpose of processing your enquiry and in the event that follow-up questions arise: title, first name and surname, postal address, email address, telephone number and details relating to the enquiry.

11. Newsletter

If you subscribe to our newsletter (for example via this Website), we will use your contact details (in particular your name and email address) to send you regular newsletters (at most once a month) containing information on current legal developments, our law firm and our services to your email address. Data relating to the technical registration process (in particular the time of registration and the completion of the double opt-in procedure) is also stored. You may unsubscribe from the newsletter and thereby withdraw your consent at any time. Once you have withdrawn your consent, your data will be deleted from the newsletter database and you will not receive any further newsletters. 

12. Cookies

This Website uses ‘cookies’ to make our service more user-friendly, effective and secure.
A ‘cookie’ is a small text file that we transmit via our web server to the browser’s cookie file on your device. This enables our Website to recognise you as a user when a connection is established between our web server and your browser. Cookies help us to determine the frequency of use and the number of users of our Website. The content of the cookies we use is limited to an identification number that no longer allows the user to be personally identified. The main purpose of a cookie is to recognise visitors to the Website.

Two types of cookies are used on this Website:

  • Session cookies: These are temporary cookies that remain in your browser’s cookie file until you leave our Website and are automatically deleted at the end of your visit.
